D'un point de vue théorique, l'étude de la thématique a pour objet d'analyser le système de financement mis en place par les principaux acteurs, les mécanismes et procédures normatifs d'endiguement de ce phénomène dont l'objectif est la fin de l'impunité. Cette recherche est un inventaire de tous les instruments nationaux, communautaires et internationaux de lutte contre le financement du terrorisme. Sur le plan pratique, cette étude présente des difficultés liées à la prépondérance des sources informelles, la politisation des institutions financières, les sanctions financières internationales parfois liberticides et la question de la légitimité des organes internationaux habilités en la matière. À côté de cela, il y a la difficulté d’identifier la réponse pénale appropriée des États qui oscille entre une incrimination de droit commun et une incrimination spéciale. Le défi actuel des États d’Afrique Centrale est de renforcer leurs dispositifs juridiques de lutte contre le financement du terrorisme en l’adaptant à l’évolution constante des sources de financement. The issue of terrorist financing is of both theoretical and practical interest. From a theoretical perspective, the aim of studying this topic is to analyse the financing system put in place by the main actors, as well as the normative mechanisms and procedures for curbing this phenomenon, with the ultimate goal of ending impunity. This research is an inventory of all national, community and international instruments for combating terrorist financing. On a practical level, this study presents difficulties related to the preponderance of informal sources, the politicisation of financial institutions, international financial sanctions that are sometimes liberticidal, and the question of the legitimacy of the international bodies empowered in this area. In addition, there is the difficulty of identifying the appropriate criminal response by States, which oscillates between common law offences and special offences. The current challenge for Central African States is to strengthen their legal mechanisms for combating terrorist financing by adapting them to the constantly evolving sources of financing.
