Facultatif ou obligatoire, ce processus, fondé sur le dialogue et la recherche d'un accord, modifie la façon dont les administrations gèrent les différends. Pour la justice administrative, face à la nécessité de réguler le flux contentieux, la possibilité pour le juge de prescrire une médiation fonde un nouveau paradigme où le procès n’est plus la voie privilégiée. Mais l’essor de la médiation implique un saut qualitatif. Le médiateur doit disposer d’un cadre déontologique qui accroît ses garanties d’indépendance et d’impartialité. Le cadre méthodologique du processus doit être mieux défini pour répondre aux impératifs de confidentialité et de confiance. La médiation contribue au renforcement continu du dialogue administratif, dépassant ainsi sa fonction première de mode de règlement des différends. The « Justice 21 » law, published in 2016, represents a major step forward for the growth of mediation, establishing it as the standard method for the peaceful resolution of administrative disputes. Whether optional or mandatory, this process, based on dialogue and the search for an agreement, changes the way in which administrations handle disputes. For administrative justice, faced with the need to regulate the flow of litigation, the possibility for the judge to prescribe mediation form a new paradigm where litigation is no longer the preferred route. But the rise of mediation involves a qualitative leap. The mediator must have an ethical framework that enhances their guarantees of independence and impartiality. The methodological framework of the process must be better defined to meet the imperatives of confidentiality and trust. Mediation contributes to the ongoing strengthening administrative dialogue, thereby exceeding its primary function as a means of dispute resolution.
