Pour ce faire, notre thèse s’appuie sur l’expérience française pour proposer certaines réformes visant à l'élargissement de la définition du concubinage (ouverture aux couples homosexuels), à la légalisation de certains droits et devoirs conjugaux pour les concubins (liquidation des intérêts communs lors de la rupture, droit à réparation du concubin survivant, droits du concubin abandonné, protection pénale, droit de représenter son concubin, droits concernant le logement commun et les aides sociales) et à l'introduction d'une nouvelle forme de conjugalité à la vietnamienne, appelée le contrat de cohabitation, inspirée du PACS français, permettant à tous les couples non mariés d’organiser leur vie commune et de bénéficier de certaines protections juridiques du mariage. The objective of this thesis is to propose a modernization of the legal definition of cohabitation in Vietnamese law and to expand the legally recognized forms of conjugal union to better address the needs of unmarried couples. To this end, our research draws on the French experience to propose several reforms, including broadening the definition of cohabitation (to include same-sex couples) and recognizing certain conjugal rights and obligations for cohabiting partners, such as the settlement of shared interests upon separation, compensation for the surviving partner, protections for an abandoned partner, criminal law safeguards, the right to represent one’s partner, housing rights, and access to social benefits. Additionally, it advocates for the introduction of a new form of conjugal union tailored to the Vietnamese context: the cohabitation contract, modeled after the French PACS. This would allow all unmarried couples to legally formalize their relationship and benefit from legal protections traditionally associated with marriage.
