Parmi un large éventail de possibilités, celui-ci est parfois qualifié de « discrétionnaire ». Ce choix ne doit rien au hasard. Derrière la liberté apparente que charrie cette notion se cache la prééminence du droit. La discrétionnarité est autant une reconnaissance qu’une limitation du pouvoir des sujets du droit international. La présente étude se propose alors d’observer comment l’usage de cette notion participe au progrès de l’ordre international. Il y a de fait une diffusion historique de la discrétionnarité, des ordres internes vers l’ordre international, dans un mouvement délibéré et discursif engagé par une partie de la doctrine internationaliste pour reléguer la souveraineté, perçue comme vectrice d’un absolutisme avec lequel la discrétionnarité rompt. L’intérêt de cette notion réside en effet dans sa capacité de se saisir du processus décisionnel. Sa décomposition analytique fait ressortir deux étapes que sont la détermination de l’opportunité de l’action puis celle de ses modalités. Ainsi placé sur une « échelle » de discrétionnarité, le pouvoir en droit international s’inscrit à nouveau dans une dialectique entre liberté et contrainte. L’étude jurisprudentielle confirme alors comment les juges internationaux ont façonné la notion autour des enjeux de respect des finalités de l’habilitation et d’adéquation des motifs. Le pouvoir discrétionnaire, passé au crible judiciaire, est autant consacré que subordonné au droit international. What words should be used to describe the power of subjects of international law? Among a wide range of possibilities, it is sometimes described as “discretionary”. This choice is not accidental. Behind the apparent freedom conveyed by the term lies the rule of law. Discretion is both a recognition and a limitation of the power of the subjects of international law. The purpose of this study is to observe how the use of this concept contributes to the progress of the international legal order. In fact, the discretionary power has historically spread from domestic orders to the international order, in a deliberate and discursive movement initiated by a part of the internationalist doctrine to relegate sovereignty, perceived as the vector of an absolutism from which the discretionary power breaks away. The interest of this concept lies indeed in its ability to grasp the decision-making process. Its analytical decomposition highlights two stages: the determination of the opportunity to act and then the modalities of that action. Thus placed on a “scale” of discretion, power in international law is once again part of a dialectic between freedom and constraint. A study of case law confirms how international judges have shaped the concept around the issues of respect for the intended purpose of the powers and the adequacy of the factual and legal grounds of the action. Discretion under judicial review is both enshrined in and subordinated to international law.
