Cette question simple ne va pas pourtant sans soulever beaucoup d’inquiétudes et vicissitudes liées à la transposition du régime présidentiel en Libye. On s’abstiendra de répondre à cette question à ce stade. Cette thèse de doctorat n’est pas un référendum en ce sens qu’elle n’a pas l’intention de répondre par oui ou par non à cette question. L’objet de la présente étude doctorale est de contribuer à un débat passionnant, celui de la reconstruction du nouvel État libyen ; comme c’est le cas de tous les pays après des années de dictature et de crise et qui s’orientent vers la démocratie. Les présents travaux de recherche se proposent d’analyser le régime présidentiel et des obstacles liés à sa possible application en Libye ; un pays où le tribalisme joue encore un rôle déterminant dans la vie politique. En effet, faute d’entente nationale, de volonté politique, d’institutions politiques démocratiques et fortes, il n’est pas certain qu’un projet de transposition du régime présidentiel et de refonte des institutions politiques en Libye aboutisse. Cet échec est lié à des traditions historiques, économiques et sociales qui influent beaucoup sur l’opinion publique et tendent à promouvoir une forme de scepticisme quant à la transposition du régime présidentiel. Depuis son indépendance le 24 décembre 1951, la Libye, qui a débuté par une monarchie constitutionnelle, a traversé différents systèmes de gouvernement et différents régimes politiques. La monarchie a été adoptée en vertu de la Constitution mise en place par l'Assemblée nationale en octobre 1951. Le gouvernement a ensuite élaboré la Constitution en instituant un système fédéral, avec un territoire subdivisé en trois régions, Tripolitaine (Tripoli), Cyrénaïque (Barqa) et Fezzan jusqu'en 1963. La possibilité d’application du régime présidentiel en Libye laisse place à la réflexion, à la discussion et au débat ; cette thèse de doctorat les y encourage. Does Libya need a presidential regime? This simple question doesn’t go without raising a lot of concerns and vicissitudes linked to the transposition of the presidential regime in Libya. This question won’t be answered at this time. This doctoral thesis isn’t a referendum in the sense that it doesn’t intend to answer yes or no to this question. The purpose of this doctoral study is to contribute to a fascinating debate, that of the reconstruction of the new Libyan state, as is the case with all countries after years of dictatorship and crisis and which are moving towards democracy. The present research aims to analyse the presidential regime and the obstacles linked to its possible application in Libya; a country where tribalism still plays a determining role in political life. Indeed, for lack of national understanding, political will, democratic and strong political institutions, it’s not certain that a project to transpose the presidential regime and overhaul political institutions in Libya will succeed. This failure is linked to historic, economic and social traditions, which greatly influence public opinion and tend to promote a form of scepticism about the transposition of the presidential regime. Since its independence on December 24, 1951, Libya, which began as a constitutional monarchy, has gone through different systems of government and different political regimes. The monarchy was adopted under the Constitution put in place by the National Assembly in October 1951. The government then developed the Constitution by instituting a federal system, with a territory subdivided into three regions, Tripolitania (Tripoli), Cyrenaica (Barqa) and Fezzan until 1963. The possibility of the application of the presidential regime in Libya leaves room for reflection, discussion and debate; this doctoral thesis encourages them to do so.
