Cent vingt ans après avoir été estampillée par Raymond Saleilles en 1901, cette notion, longtemps demeurée doctrinale, pénètre le champ du droit positif en intégrant le Code civil lors de la réforme du droit des contrats de 2016. Toutefois, cette réception n'a pas manqué de soulever des interrogations quant à sa pertinence et son utilité. Pour une partie de la doctrine française, c'était tout simplement une mauvaise idée - ou une fausse bonne idée - que d'avoir introduit la notion de contrat d'adhésion, et par extension son régime, parmi les dispositions du droit commun des contrats. Or, l'intérêt de la notion de contrat d'adhésion réside dans le lien qui l'unit au principe de justice contractuelle. Ce lien est, tout d'abord, consubstantiel en ce que le contrat d'adhésion a toujours accompagné le mouvement d'affirmation et d'émancipation de la justice contractuelle, et ce depuis sa naissance. Il est ensuite devenu indissoluble grâce au régime du contrat d'adhésion qui permet une protection pratique et effective de la justice contractuelle. C'est à travers l'étude de ce lien original, et l'expérience positive tirée du droit des contrats québécois, que cette étude comparative cherche à justifier l'intérêt d'avoir intégré une notion qui modifie substantiellement le droit commun des contrats et, par conséquent, provoque un changement de paradigme au sein de la théorie générale du contrat. D'une théorie générale homogène, nous sommes désormais passée à une théorie dualisée. Deux pôles composent désormais cette théorie : d'un côté, le régime du contrat négocié, de l'autre, celui du contrat d'adhésion. Cette dualisation permet de revisiter la théorie générale du contrat afin de l'adapter aux contingences contractuelles contemporaines. Précurseur d'un prochain renouvellement plus profond de ladite théorie, l'intégration de la notion de contrat d'adhésion au sein du droit droit des contrats invite à voir autrement le rapport contractuel. However, the insertion of the notion has led to doubt its purpose and its relevance. According to some French authors, inserting the notion of contract of adhesion and its regime among the other rules of the law of Contract may simply have been a bad idea - or, at least, a bad idea in disguise. Yet, the notion of contract of adhesion displays a particular purpose in the link tying it to the principle of contractual justice. Firstly, this connection seems to be intrinsic. In fact, since its creation, the notion of contract of adhesion has always been part of the assertion and expansion of the principle of contractual justice. Secondly, this link appears now to be unbreakable. Indeed, inserting the contract of adhesion and its regime within the French Civil Code helps to reinforce the principle of contractual justice by giving it a practical purpose. Through exploring this special connection and learning from the positive lessons drawn by Quebecker Civil law of Contracts, this given comparative law essay aims to argue in favour of the introduction of a notion, and its regime, that substantially change the law of Contracts by triggering a drastic paradigm shift. From an organic theory of contract, we're now given a dual theory . On the one hand, there's the regime of the negotiated contract and, on the other hand, there are the provisions of the contract of adhesion. This shift helps to revisit the theory of contract in order to for it to answer the contractual needs and imperatives of today contractual relationships. Precursor of a potential renewal of the theory of contract, the insertion of the notion of contract of adhesion within the law of Contract leads to see and appreciate contractual relationships differently.
