Elle interroge la vocation du droit de la propriété intellectuelle à la protection d’un tel investissement. À l’examen du droit positif, il n’est pas aisé d’identifier une réponse claire à cette question.L’existence de la protection est incertaine, alors même que la technique employée est adéquate. Discutée, elle mérite d’être repensée. Son avenir dépend par ailleurs de son caractère souhaitable, et donc de sa légitimité. Aussi, pour être effective, la protection doit faire l’objet d’un choix politique de société. Proposantune lecture de la propriété intellectuelle sous l’angle de sa finalité de protection de l’investissement, l’étude est menée à l’appui de la construction d’un concept juridique d’investissements immatériels. Celle-ci permet de présenter le sujet et ses problématiques de façon renouvelée, afin de dépasser les difficultés. Le résultat de l’exercice de conceptualisation, conjugué à un exercice de classification juridique de la réalité, sert de base à un essai de reconstruction prospective du système juridique de la propriété intellectuelle. Les catégories, qualifications et régimes de ce dernier sont réaménagés, pour le faire évoluer en équilibre et cohérence, vers une fonction assumée de protection de l’investissement. L’enjeu est d’aboutir à un système de protection légitime, sécurisant et fidèle à la réalité et ses attentes. The thesis focuses on the relationship between investment in the design of intangible objects and intellectual property. It questions the intellectual property law vocation to the protection of such an investment. On the positive law examination, it is not easy to identify a clear answer to this question. Theexistence of protection is uncertain, even though the technique employed is adequate. Discussed, it deserves to be rethought. Its future also depends on its desirability, and therefore on its legitimacy. Furthermore, in order to be effective, protection must be the subject of a societal political choice. Providing a discourse of the intellectual property from the perspective of its investment protection purpose, the study is conducted in support of the construction of a legal concept of intangible investments. The study allows to present the subject and its complexities in a new way, in order to overcome the difficulties. The result of the conceptualization exercise, combined with an exercise of legal classification of reality, serves as a basis for an attempt at prospective reconstruction of the legal system of intellectual property. The latter’s categories, qualifications and regimes are rearranged, to ensure it evolves in balance and coherence, towards an assumed function of investment protection. The challenge is to achieve a legitimate protection system that is secure and faithful to reality and its expectations.
